Inspectorate America Corporation Overtime Pay Lawsuit Certified as Collective Action, Announces Morgan & Morgan

(EMAILWIRE.COM, March 19, 2010 ) Davie, FL - Brantley v. Inspectorate America Corporation, a lawsuit involving allegations of unpaid overtime wages and violations of the Fair Labor Standards Act, has been certified as a collective action. The Plaintiffs in this action, represented by Morgan and Morgan, are Oil, Gas, and Chemical Inspectors who claim that they did not receive proper compensation for overtime hours worked.

Brantley v. Inspectorate America Corporation (Case Number: 4:2009cv02439) was filed on July 30, 2009 in the Southern District of Texas. The presiding judge is Judge Vanessa D. D. Gilmore.

In this collective action lawsuit, the Oil, Gas, and Chemical (OGC) Inspectors allege that Inspectorate America Corporation violated the Fair Labor Standards Act by failing to properly compensate them for overtime hours. The OGC Inspectors were responsible for inspecting incoming shipments of oil, gas, and chemicals at coastal locations. Although they regularly worked over forty hours per week, the Defendant did not properly compensate them for those hours. Instead, they were paid only "half-time" or "Chinese Overtime," rather than time-and-a-half.

Morgan and Morgan overtime attorney Andrew R. Frisch is representing the OGC Inspectors in an effort to recover unpaid wages for the overtime work they performed, but for which they did not receive the proper overtime pay. According to a federal law known as the Fair Labor Standards Act (FLSA), non-exempt employees are entitled to time-and-a-half pay for all hours worked over forty in a given workweek. A pay practice that is similar to the one practiced by Inspectorate America Corporation was previously been found to be illegal in another overtime lawsuit handled by Morgan and Morgan, Adeva v. Intertek.

Now that the collective action has been certified, all unpaid overtime claims filed by OGC Inspectors who worked for Inspectorate America Corporation can be combined in a single legal action.
